Your Charter Rights and Arbitrary Detention in Canada

When approached by a police officer, most people feel obligated to comply and engage in conversation. What many don’t realize is that Section 9 of the Canadian Charter of Rights and Freedoms protects individuals from arbitrary detention—which occurs when police restrict your liberty without legal justification.

A detention doesn’t always involve handcuffs or an arrest. If a police officer makes you feel like you’re not free to leave—even without saying so directly—that could constitute a detention. Unless the officer has reasonable grounds to suspect you were involved in a criminal offence, the detention may be considered illegal.

At Affordable Defence, we carefully examine the legality of any police stop or interaction. If you were detained unlawfully, any evidence gathered may be excluded from trial, potentially resulting in charges being reduced or withdrawn entirely.

Know Your Charter Rights Under the Highway Traffic Act

In Ontario, police have broad powers to stop vehicles under the Highway Traffic Act—but that power is not unlimited. You can be pulled over so police can check:

  • Your licence, registration, and insurance
  • The vehicle’s mechanical condition
  • Whether the driver is impaired or otherwise fit to drive

What many drivers don’t realize is that these types of stops are administrative in nature, not criminal investigations. Police cannot lawfully use these stops as a pretext to investigate you for unrelated suspected criminal activity. Doing so could violate your Charter rights under Section 8, which protects against unreasonable search and seizure.

Unless police can demonstrate clear legal grounds—such as the smell of alcohol, visible drugs, or an admission—they do not have automatic authority to search your vehicle. If your rights were violated during a vehicle stop, contact Affordable Defence immediately to preserve your defence options.

Under the Canadian Charter of Rights and Freedoms, your home is protected by some of the strongest privacy laws in the country. Police cannot enter your residence without one of the following:

Granting entry may be construed as implied consent, but it does not give them the right to search your home or belongings. Any search without a warrant—or beyond the scope of a warrant—is likely unconstitutional.
